1. Overview
MADCAP respects intellectual property rights. If you're a rights-holder and believe that content on MADCAP infringes your copyright, trademark, or other IP, this page explains how to tell us.
The takedown procedure below mirrors the process described in the US Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. We treat valid notices the same way a registered service provider would and act on credible notices in good faith. We follow the same procedure for non-US IP claims (see Section 5).
Safe-harbor status. Formal registration of a designated agent with the US Copyright Office is on our roadmap. Until that registration completes, MADCAP does not claim eligibility for 17 U.S.C. § 512(c) safe-harbor protection. The procedure below is fully operational and notices sent to the address in Section 6 will be acted on regardless.
2. Filing a takedown notice
To file a DMCA takedown notice, send an email to eytan@redbeard.co.il with subject line "DMCA Takedown Notice." The notice must include:
- Your physical or electronic signature.
- Identification of the copyrighted work you claim has been infringed (e.g., a registration number, a URL where your work appears, or a description sufficient to identify it).
- Identification of the material on MADCAP you claim is infringing: please include the exact URL on mad-cap.com and a screenshot.
- Your contact information (full name, address, phone, email).
- A statement, made under penalty of perjury, that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the owner of the copyright or authorized to act on the owner's behalf.
We'll review and respond within 5 business days. If the notice is complete and credible, we'll remove or disable access to the material and notify the user who submitted it.
False notices.Filing a DMCA notice in bad faith (i.e., misrepresenting that material is infringing) can subject you to liability for damages under 17 U.S.C. § 512(f). Please don't.
3. Counter-notice
If your content was removed and you believe it was a mistake or misidentification, you can file a counter-notice. Send an email to eytan@redbeard.co.il with subject line "DMCA Counter-Notice" including:
- Your physical or electronic signature.
- Identification of the material removed and its location before removal.
- A statement, made under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
- Your contact information (name, address, phone, email).
- A statement that you consent to the jurisdiction of the federal court for the judicial district where you live (or for the Central District of California if you're outside the US), and that you will accept service of process from the original notifier.
If we receive a valid counter-notice, we'll forward it to the original notifier. If they don't file a court action within 10–14 business days, we may restore the removed material.
4. Repeat infringers
We terminate accounts of users who are determined to be repeat infringers, as required by the DMCA's safe-harbor provisions. "Repeat infringer" means a user with multiple credible takedown notices not successfully counter-noticed.
5. Outside the US
If you're a rights-holder outside the US asserting a non-copyright claim (trademark, design right, sui generis database right, etc.), we follow the same notice procedure as above. Use subject line "IP Takedown Notice" and identify the specific right (e.g., "EU Trade Mark No. 0123456") and the legal basis for your claim.
